"Platform" refers to the FlexiFit VIP web application. "User" refers to any individual who accesses or uses the Platform. "Content" refers to all text, data, images, and other materials available on or through the Platform. "AI Content" refers to workout plans, food analysis, and other outputs generated by artificial intelligence.

Eligibility

You must be at least 13 years of age to use FlexiFit VIP. By creating an account, you represent that you meet this age requirement. If you are between 13 and 18, you must have parental or guardian consent.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Security

You must use a strong password and keep it confidential. We are not responsible for any loss or damage arising from your failure to protect your account credentials.

Service Description

FlexiFit VIP provides AI-powered fitness and nutrition tracking tools, including workout plan generation, food photo analysis, barcode scanning, body measurement tracking, water and step tracking, and exercise library access.

Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, exploit, or disrupt the service
• Share your account credentials with third parties or allow others to access your account
• Upload malicious content, viruses, or attempt to compromise system security
• Use automated tools, bots, or scrapers to access the platform
• Impersonate another person or misrepresent your identity

AI-Generated Content

Workout plans and food analysis are generated by artificial intelligence and are provided for informational purposes only. They do not constitute medical, nutritional, or professional fitness advice. Always consult a qualified professional before starting any exercise or nutrition program.

Limitations of AI

AI-generated content may contain errors, inaccuracies, or may not be suitable for your specific health conditions. You acknowledge that you use AI-generated content at your own risk and discretion.

User Content

You retain ownership of all content you submit to the platform (photos, notes, profile data). By submitting content, you grant us a limited license to use it solely for providing and improving our services.

Intellectual Property

All content, designs, trademarks, and technology on FlexiFit VIP are owned by Quantum Digital FZ-LLC or its licensors and are protected by international intellectual property laws.

Service Availability

We strive to maintain the platform's availability but do not guarantee uninterrupted or error-free service. We may suspend or modify the service at any time with reasonable notice.

Usage Limits

Certain features are subject to daily usage limits (e.g., AI workout generation, food scanning). These limits are in place to ensure fair use and service quality for all users.

Limitation of Liability

To the maximum extent permitted by law, Quantum Digital FZ-LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform, including but not limited to loss of data, personal injury, or property damage.

Indemnification

You agree to indemnify and hold harmless Quantum Digital FZ-LLC, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

Termination

We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the platform ceases immediately. You may delete your account at any time by contacting us.

Disclaimers of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Quantum Digital FZ-LLC regarding the use of the platform.

Governing Law

These terms are governed by and construed in accordance with the laws of the United Arab Emirates as applicable in the Emirate of Ras Al Khaimah. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah.

Force Majeure

Quantum Digital FZ-LLC shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet failures, or third-party service outages.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the platform after changes constitutes acceptance of the revised terms.
